Abstract

ABSTRACT This study aims to gain a deep understanding of how the rules related to the use of weapons of war are regulated in the context of armed conflict in International Humanitarian Law (IHL) according to the Hague Convention. The focus of this study is to examine the regulations governing the use of these weapons with the aim of reducing the negative impacts that may be experienced by civilian victims and the environment during the conflict. This study also focuses on how to enforce the law against violations of international humanitarian law, especially in terms of the use of weapons of war in the midst of armed conflict. The law enforcement process studied includes identifying violations, investigating, and imposing sanctions on parties who violate these international rules. Thus, the results of this study are expected to provide a comprehensive picture of the effectiveness of regulations and the application of laws in limiting the use of prohibited weapons of war and ensuring sanctions or accountability for violators, while supporting efforts to protect human rights and maintain global peace stability. The type of research that the author uses in this study is a normative research type, namely conducting research that analyses documents by utilising various existing secondary data sources. Then, the method of drawing conclusions that the author uses is the deductive method, namely drawing conclusions from general to specific. From the results of the research that the author has conducted, the author found several things, namely: first, the mechanism for regulating the use of weapons of war in international humanitarian law. This regulation has been implemented through various international legal instruments such as the Hague Convention, the Geneva Convention, and a number of other agreements that regulate the prohibition or restriction of certain types of weapons, such as chemical, biological, conventional, and nuclear weapons. This entire legal framework provides legitimacy for countries in formulating their military policies so that they remain in line with international standards that uphold humanitarian values. Second, sanctions for violations of the use of prohibited weapons in international humanitarian law. The forms of sanctions that can be imposed include diplomatic pressure, economic restrictions, and legal prosecution at the international level through institutions such as the International Criminal Court (ICC). In addition, the United Nations (UN) Security Council has the authority to take collective action to maintain global stability and justice.
