Abstract

The term accounts payable in fiqh terminology is known to use the word "al-Qardhu", and there is also the word "ad-Daynun". Accounts payable with lafadz al-Qardh, are accounts payable in the form of goods or money with consumptive purposes. In the midst of the Malay community who work as farmers in the Penghuluan Bagan Punak Pesisir, a custom has developed that has been passed down from generation to generation, namely the Pebawu Padi Tradition. pebawu is a debt transaction that occurs between debtors (farmers) and creditors (lenders/debt) either in the form of goods (paddy or rice) or in the form of money, when farmers (debtors) want to start their work (cultivation) and the debt is returned after completion harvest, in the form of agricultural products (paddy/rice). The formulation of the problem in this study is how to analyze the Akad Qardh in the pebawu padi tradition in the Bagan Punak Pesisir Malay community Kecamatan Bangko Kabupaten Rokan Hilir. While the purpose of this study was to find out the analysis of the Qardh contract in the pebawu padi tradition in the Bagan Punak Pesisir Malay community Kecamatan Bangko Kabupaten Rokan Hilir. This type of research is field research using qualitative research. The population in this study was 5 people, in determining the research sample using a saturated sample, namely the sampling technique if all members of the population are used as samples. Data collection techniques in this study were through observation, interviews, and documentation based on data analysis that the author conducted on the results of interviews with Malay people who work as farmers in Kepenghuluan Bagan Punak Pesisir. It can be concluded that this tradition is contrary to the principles in the qardh contract in Islam. Because, from this tradition both parties, both creditors and debtors (farmers) carry out what is unlawful, namely carrying out ribawi transactions. Then, the addition of the qardh contract in the pebawu padi tradition violates the purpose of the contract and the syar'i meaning of the qardh contract itself. Where, a qardh contract takes place with the aim of helping (tabarru'), then repaying the loan is in the form of a harvest, while the loan given is in the form of money, violating the meaning of the qardh contract in Islam.Qardh, Pebawu
