Abstract

The thesis entitled "Legal Analysis of the Spread of Film Footage Uploaded on the Telegram Application Based on Law Number 28 of 2014" discusses the development of an increasingly modern era and emerging skills, one of which is filmmaking. The movie has a time limit when the movie is over. And the film has a license for Intellectual Property Rights, which are rights to do something about intellectual property that is regulated by applicable norms or laws, including copyrights. Copyright is the exclusive right of the creator that arises automatically based on the declarative principle after a creation is realized in a tangible form without reducing restrictions in accordance with statutory regulations. Have a problem statement that explains: 1) how is the legal protection against the dissemination of film footage uploaded to the Telegram application without permission? 2) how is the resolution of copyright infringement with copyrighted works against the distribution of films based on law number 28 of 2014 concerning copyright? This research includes field research with the type of empirical research method or also known as the sociological approach which has the characteristic of descriptive analysis. Data collection in this study was obtained through interviews and documentation with the Head of the Ministry of Law and Human Rights, admin of the public channel for distributing films and several Telegram users, then analyzed using a descriptive method of analysis with a deductive mindset, namely a mindset based on Law Number 28 of 2014 Regarding Copyright, after that it is related to facts in the practice of distributing films on the Telegram application. The results of the research conclude that: 1) legal protection is an effort to protect one's interests by allocating a power. Film is a cinematographic work and is one of the subjects protected under copyright which has properties based on copyright ability, moral rights and economic rights. 2) an intellectual work that is protected by copyright. When a movie is downloaded without the permission of the copyright owner, what happens is the violation and sanctions stated in Law Number 28 of 2014 Concerning Copyright.Copyright, Intellectual Property Rights, Film, Telegram
