Abstract

Marriage in Indonesia has is regulated by the state, the state pays attention and at the same time has the responsibility to control and provide direction regarding marriage which is a social institution in protecting and upholding women's dignity. Law Number 16 of 2019 Concerning Marriage, In article 7 paragraph 1 which has just been stated, that marriage is only permitted if a man and a woman have reached the age of 19 (nineteen) years. Even though the age limit for marriage has been set in such a way in statutory regulations, it does not rule out the possibility for someone to enter into an underage marriage. So more concretely, the problem of this research is what are the problems if dispensation of marriage is given to minors and what are the legal consequences if dispensation is given to marriage to minors in the Pasir Putih area of ??Baru Village. However, the reality that occurs in the underage marriage community has an impact on harmony in marriage, where due to the desire to get married but has not reached psychological maturity or it can be said that they are not old enough to cause instability in the household and cause seriousness in carrying out the marriage. The method used is the Inductive method, namely by taking facts or data related to research, analyzed and then general conclusions are drawn. The purpose of this study is to find out what are the problems with dispensation from marriage to minors and to find out what the legal consequences are if dispensation from marriage is given to minors in the Pasir Putih area of ??Baru Village. So to achieve the goal of marriage, careful preparation is needed before getting married, including the mature age for marriage. Problems that arise in the household for couples who get marriage dispensation, namely economic/financial problems, increasing cases of early divorce, increasing maternal mortality during pregnancy or childbirth, from a social perspective they are also vulnerable to domestic violence, as well as sons who Marrying at a young age, because of limitations and emotional immaturity for a household will tend to become perpetrators of violence and legal consequences.
