Abstract

Protection of the rights of workers who do not get overtime pay in Law Number 13 of 2003 concerning Manpower in which in this case the company does not fulfill its obligation to pay overtime pay to employees who are overtime, causing disputes. This research covers the main issue of how legal protection is for workers who exceed the working hours limit based on Law Number 13 of 2003 concerning Employment at PT. Tri Bakti Sarimas and how legal remedies are for workers who exceed working hours limits based on Law No. 13 of 2003 concerning Employment at PT.Tri Bakti Sarimas Pekanbaru. The research method used in this study is empirical juridical, namely conducting direct field research, using interview and questionnaire data collection tools. The nature of this research is descriptive in that it provides an overview of legal protection and legal remedies against workers who exceed working hours and are not given overtime pay. This study uses primary data and secondary data. Based on the research results, it is known that legal protection for workers who work overtime working hours based on Law No. 13 of 2003 concerning Manpower has not been carried out as mandated by existing regulations, namely providing overtime pay to workers who work overtime working hours. The settlement of the dispute has not yet found a bright spot and is still in the process of being resolved between the two parties.
