Abstract

The existence of Base Trasnceiver Station (BTS) tower infrastructure in residential areas can cause concern for residents who live around the BTS tower. Such is the case to residents who live around the BTS tower of PT. Telekomunikasi Seluler on Cahaya Puri street, Pekanbaru, because of the damage to residents' electronic device due to lightning strikes on the BTS tower. This happened because of the mistake of PT. Telekomunikasi Seluler so that PT Telekomunikasi Seluler should be responsible for the losses caused in accordance with Article 15 of Law Number 36 of 1999 concerning Telecommunications. But the implementation is still not optimal. Residents who are harmed complain about the length of the compensation process, the existence of electronic device that are not repaired, and the installation of lightning rods are not implemented for residents who have experienced the same loss three times. Based on these problems, there are 2 (two) main problems, including the following : How is the responsibility of PT. Telekomunikasi Seluler for damage to residents' electronic device due to lightning strikes on BTS tower, and What are the obstacles to the implementation of compensation for residents' electronic device damaged by lightning strikes on BTS tower. According to the type, this research is included in socio – legal research, which is research directly conducted to the field with data collection methods are interviews and questionnaires. Meanwhile, the nature of this research is descriptive – analytical. The results of the research show that the responsibility carried out by PT. Telekomunikasi Seluler to residents who are harmed by lightning strikes on BTS towers is to provide compensation in the form of repairing damaged electronic goods either directly repaired by PT. Telekomunikasi Seluler or repaired by residents themselves with the repair costs borne by PT. Telekomunikasi Seluler. If the electronic devices cannot be repaired anymore, it will be replaced with a new unit. In addition, another form of responsibility provided by PT. Telekomunikasi Seluler is in the form of installing lightning rods in the homes of residents who have experienced the same loss for 3 times. Some obstacles that make the implementation of compensation not optimal are residents who do not know the information on compensation, residents who are harmed are not at home when the officer comes to pick up the damaged electronic devices, the length of response from BMKG regarding confirmation of the time and place of lightning, the unavailability of spare parts for the damaged electronic devices, and residents who refuse if the damaged electronic devices are only repaired.
