Abstract

The presence of Covid-19 has had a major impact on paralyzing activities in various sectors. One of those affected was the religious sector, namely the cancellation of all Hajj and Umrah pilgrimage activities for the international community, especially Indonesia. This was reinforced by the issuance of a decision by the Minister of Religion of the Republic of Indonesia to cancel the 2020 Hajj pilgrimage. This cancellation is detrimental to pilgrims and service providers because their respective rights and obligations cannot be fulfilled, especially since Covid-19 is included in the force majeure category. The method used in this research is socio-empirical. Taking the object of study in terms of law which has empirical value, to answer questions that have been prepared by observation as done by the author, namely interviews with pilgrims and service providers. After the data has been obtained, it is grouped into primary data, secondary data, and tertiary data. Then the data is grouped according to the type of problem to be studied and the material obtained from the interviews will be presented by the author as a description for discussion. Based on the results of the study it can be concluded that pilgrims (consumers) do not get their rights fulfilled and service providers cannot fulfill their obligations due to the Covid-19 pandemic. However, service providers continue to be accountable to their consumers by defending their rights and acting in good faith so that consumers feel that their rights are still being protected.
