Abstract

We often encounter violations of consumer rights in the field of parking services in everyday life. The violation is in the form of no responsibility from the parking service business actor in the event of loss and damage to the vehicle entrusted by the consumer in the parking area. The main problem in this study is how the form of legal action taken by users of parking services if they experience loss of vehicles/accessories as a result of using parking services. The type of writing that researchers use in this study is sociological legal research using qualitative research methods with a juridical-sociological approach. The research location was conducted in the Metropolitan City of Pekanbaru. Sources are Primary Data and Secondary Data. While the data collection techniques in this study were Observation, Interview, Documentation, and Literature Study, then after the analysis was carried out a conclusion was drawn on a qualitative basis which was described descriptively from the data that had been obtained by the inductive thinking method, namely a statement that is general in nature becomes a statement that special. From the results that the researchers collected, there were two factors for the occurrence of losses in the parking area. The first factor is the loss of a motorized vehicle due to the negligence of the parking manager. And the second factor, namely loss of motorized vehicles due to negligence of parking service users. Which second factor is not in accordance with the Consumer Protection Act No. 8 of 1999 concerning Consumer Protection which prohibits business actors from transferring responsibility. If there is no response from the parking manager, if a vehicle is lost, then the consumer who uses the parking service can take legal action by suing the consumer dispute resolution agency or submitting a court case at the consumer's domicile.
