Abstract

The 2020 Pelalawan District Head Election found several violations, from criminal election violations such as money politics, administrative violations such as the issue of ASN neutrality, ethical violations such as violations committed by the District Oversight Committee which were eventually dismissed to other violations. Regional head election violations in Pelalawan Regency still occur even though they have been regulated in the Pilkada Law as well as derivative regulations such as KPU Regulations and Bawaslu Regulations. The purpose of this study is to find out the duties and authorities of the Election Supervisory Board of Pelalawan Regency in resolving violations of the 2020 simultaneous regional elections and what obstacles they face. In this study, the authors used a type of sociological or empirical research or field research. As for the samples in this study were the Chairperson of the Bawaslu 1 person, the members of the Bawaslu 1 person. Based on the results of the research, the following conclusions were drawn: 1) 1. The Implementation of the Duties and Authorities of the Election Supervisory Board of Pelalawan Regency in Resolving Violations in the 2020 Simultaneous Regional Head Elections did not go well. In the Simultaneous Regional Elections in Pelalawan Regency in 2020 there were 20 types of violations, consisting of 16 findings, including 2 types of administrative violations, 1 ethical violation, 7 criminal violations, and 6 other legal violations, then there were 4 reports that fall into the category of criminal offenses. Of the 20 types of violations, there were 14 types of violations that were followed up for settlement, 6 were the number of violations that were stopped, 13 were the types of violations that were recommended and followed up. The violations that are rife are ethical violations, administrative violations, ASN neutrality violations. The Pelalawan Regency Bawaslu duties include overseeing, accepting nominations, determining candidates, conducting campaigns, managing campaign funds, distributing election logistics, conducting voting, counting votes, preventing the practice of money politics, and evaluating the implementation of elections. The authority of the Pelalawan Regency Bawaslu includes receiving and following up on reports related to election violations, examining, studying, recommending and requesting information needed from related parties. 2) Based on the data obtained, there were 20 types of violations, 14 types of violations were followed up for resolution, 6 were the number of violations that were stopped, and 13 were the number of violations that were recommended and followed up. Cases of violations that were stopped were resolved because they were not serious violations and the sanctions given were also relatively light, namely only in the form of verbal or moral warnings. Constraints and obstacles for Bawaslu in resolving violations, namely the time in handling the violation process, among others, the handling time is very short, namely 14 days in one case, the lack of evidence that the violation is a criminal offense, and other obstacles are not contrary to serious law or only classified as disciplinary and moral issues.
