Abstract

The transfer of land rights can be obtained by way of sale and purchse, sale and purchase is a reciprocal agreement in which the seller gives up the right to ownership of goods and the buyer makes payments to obtain these rights. The implementation of the transfer of land ownership through sale and purchase can only be registered with a deed made by a Land Deed offficial (PPAT) in accordance with the proviions of article 37 paragraph (1) of Government Regulation Number 24 Of 1997 concering Land Registration, but the sale and purchase carried out on the Kavling Bukit Indah Nongsa IV is carried out under the hand or by agreement of the two parties only by usin receipts as proof of transfer and is not carried out in the presence of a Land Deed Official (PPAT). There are two main problems in this research, the first is about how the position of the sale and purchase of land Kavling Bukit Indah Nongsa IV Batam under the hand and the second problem is how the legal protection of the sale and purchase of land Kavling Bukit Indah Nongsa IV Batam under the hand. This research can be classified into empirical legal reseach using qualitative methods. The nature of this research is descriptive analysis that describes the facts of the research conducted. The location chosen to conduct the research in Kavling Bukit Indah Nongsa IV. The results of the research conducted by the author can be concluded that the position of the sale and purchase of land Kavling Bukit Indah Nongsa IV Batam under the hand is not legally justified.The receipt used as evidence of transfer in the sale and purchase of land rihts under the hand does not have stron leal force on the clarity of the transfer of rihts, only has formal evidentiary power so that it cannot be used as a basis for land reistration. Because the transfer of land rights throgh sale and purchase can be registered with the inclusion of a deed made by a Land Maker Official (PPAT) in accordance with article 37 Paragraph (1) of Goverment Regulation Number 24 Of 1997 concernin Land Registration. The form legal protection of sale and purchase under the hand or not done in front of a land Land Deed Official (PPAT) who only uses receipts as evidence does not guareantee that the buyer will get perfect legal protection because the sale and purchase process is not in accordance with applicable legal procedures, then repressive legal legal protection by filing a lawsuit to the court cannot be done because of the weak evidence owned.
