Abstract
The world was shocked at the beginning of 2020 by the spread of a new virus or pandemic, namely coronavirus with the scientific name (SARS-Cov-2), a new variant of this virus was discovered initially in Wuhan, China and it was only later discovered that this virus was an infectious disease caused by coronavirus, virus, Apart from humans, this virus was originally found in animals, and this virus begins with symptoms experienced by humans such as coughing, flu, and can even cause death. Seeing this, Pekanbaru City can be said to be one of the areas subject to PSBB stipulation, the Mayor of Pekanbaru also said the spread of COVID 19 is very high, in accordance with "Article 2 of Minister of Health Regulation Number 9 of 2020", found during the implementation of the PSBB by the Pekanbaru City Government, PSBB violations were found, according to data that the author found from the Pekanbaru Police there were 1,548 violations against entrepreneurs who did not close their business premises according to PSBB regulations, there were also 4,581 violations by people who did not wear masks. The main problem of this research is how to apply Article 93 of Law Number 6 of 2018 concerning Health Quarantine for people who gather during the Covid- 19 pandemic in the jurisdiction of the Pekanbaru City Resort Police and what are the obstacles to the implementation of Article 93 of Law Number 6 of 2018 concerning health quarantine for people who gather during the Covid-19 pandemic in the jurisdiction of the Pekanbaru City Resort Police. This research is included in observational research (Non-Doctrinal) or survey. Meanwhile, judging from its nature, it is analytical descriptive. Research was carried out in the field to collect data in the form of questionnaires and interviews that were linked to laws and expert opinions regarding the implementation of article 93 of law number 6 of 2018 concerning health quarantine for people who gathered during the Covid-19 pandemic in the jurisdiction of the city resort police. Pekanbaru. From the research results, it can be concluded that Article 93 of Law no. 6 of 2018 concerning Health Quarantine shows that its implementation is still far from achieving the expected legal objectives. There are several reasons that support this statement. First, the maximum prison sentence of one year imposed is not commensurate with the error committed. Second, this sanction is not effective in creating a deterrent effect for perpetrators, so it is unable to prevent quarantine violations. Third, the unclear legal status of criminal quarantine sanctions. Obstacles faced in implementing Law no. 6 of 2018 concerning Quarantine, including the large number of people who still do not believe that Covid-19 exists and that it is unusual for people with a new life (New Normal) which requires people to limit activities outside the home and use masks when doing activities outside.
