Abstract

In the implementation of Subsidized Housing Loans (KPR) at low cost, very often in credit agreements carried out by the bank as a creditor and the owner of a KPR house as a debtor for a house financed by a Subsidized KPR, it is often not accompanied by the installation of a Mortgage Deed. This is due to the low cost of Subsidized KPR that must be borne by the debtor, so that in the agreement on the Subsidized Mortgage credit transaction that is installed is a Power of Attorney for Imposing Mortgage Rights (SKMHT) only. Based on the background above, the problem that will be answered in this thesis research is about How the Subsidized Housing Loan (KPR) Agreement is Implemented at PT. State Savings Bank (Pesero) Tbk in Pekanbaru City? What are the settlement efforts made with the occurrence of defaults in PT. State Savings Bank (Pesero) Tbk in Pekanbaru City? This type of research is observational research by means of a survey, namely research that takes data directly from the population/respondents by conducting interviews as a data collection tool, then processing the data collected so that conclusions are obtained using the deductive method. Meanwhile, if viewed from its nature, this research is descriptive, namely research that explains in the form of clear and detailed sentences. Settlement efforts made with the occurrence of Default in Subsidized KPR Credit consist of: a. Rescheduling is an effort to save KPR by determining payments in installments or existing arrears, b. Debtor Transfer, namely the transfer of rights and obligations from the old debtor in accordance with the KPR agreement to the new debtor as a replacement. This new debtor replaces his position with the old debtor with all rights and obligations with BTN's prior approval. c. Subrogation is one of BTN's efforts to save credit by replacing the rights of the debtor or creditor by a third party who has paid all debts of the debtor. This subrogation is also a credit rescue. d. The lawsuit against the debtor through the District Court is to obtain the rights owned by the creditor again, the debtor must return the debt through the applicable legal procedures. e. Execution through the State Receivables and Auction Agency, namely a process of buying and selling goods or services by offering to bidders who offer their bids at a higher price, then the seller sells goods to a higher bidder.
