Abstract

This study aims to find out, examine, analyze the comparison of arrangements for disgorgement and disgorgement funds for investors' losses between Indonesia and the United States as legal protection for capital market investors. The formulation of the problem posed is: How is the regulation of legal protection for Capital Market investors in Indonesia and the United States? And what are the results of the comparison of legal protection arrangements for capital market investors in Indonesia and the United States? This research includes a typology of normative legal research. The analysis was carried out using statutory, conceptual and comparative approaches. The data sources used are secondary data sources in the form of primary legal materials, and secondary legal materials, and tertiary legal materials. Methods of data collection using literature study. The collected data was then analyzed through qualitative data analysis. From the results of this analysis, the researcher concludes that the regulation of illegal profit returns and investor compensation funds as an effort to protect the law for capital market investors in Indonesia is still not optimal in providing legal protection both preventively and repressively if it is not harmonized with existing regulations. This study recommends harmonization of regulations in the capital market sector so that these regulations can work effectively and provide protection for capital market investors.
