Abstract

Regarding the form of consumer protection in purchasing goods, consumers have the right to obtain security in consuming goods, the right to obtain correct, clear and honest information about the condition of the goods. It is undeniable that consumers often obtain goods that do not comply with the distribution permit, so they are not safe for consumption. For example in the circulation of illegal cigarettes. Education and socialization regarding the circulation of illegal cigarettes to help consumers get their rights. This study aims to determine legal protection for consumers against the distribution of illegal cigarettes. As for this research, the authors formulate the main issues as follows: First, how is the legal protection for the circulation of illegal filter cigarettes that harm consumers according to Law Number 8 of 1999 concerning Consumer Protection in Pekanbaru City. Second, what are the responsibilities of business actors for the circulation of illegal filter cigarettes which are detrimental to consumers according to Law Number 8 of 1999. In this thesis research, the authors used an empirical legal research approach or observatory research, namely research to collect data through certain individuals or physical samples with the aim of being able to generalize this research. The results of the research and discussion that the authors found are as follows: first, regarding legal protection for the circulation of illegal cigarettes that harm consumers according to the Consumer Protection Act No. 8 of 1999 concerning consumer protection, it has strictly and in detail regulated consumer rights. Second, the responsibility of business actors for consumers who have been harmed in the UUPK has provided significant regulations regarding the obligations of business actors, the responsibilities of business actors, actions that are prohibited for business actors, and sanctions imposed on business actors if it is proven to harm consumers.
