Abstract

Childbirth is defined as a procedure performed to facilitate the birth of a baby. The wrong practice can cause the victim to suffer a loss of life, and mostly the cases like this will be resolved by restorative justice. This research was conducted with the aim of seeing the application of restrorative justice. Restrorative justice is a approach that focuses more on the creation of fair and balanced conditions for the perpetrators and the victims themselves. The objectives of restrorative justice also have different goals, namely the method of reducing crime by holding meetings between victims and perpertrators, and sometimes requiring the participation of representatives from the community. The point, is to tell each other about what happened, discuss who was harmed by their crimes, and how they can deliberate about what the perpetrators should do to atone for their crimes. This can include providing compensation to victim, apologizing, or taking measures to prevent the incident from happening again. This study uses a qualitative method by conducting interviews with key informants and related informants. The results of this study, the midwife concerbed, conducted a negligence in which the incidence of fracturs in the baby’s shoulder causes the baby’s posture to imperfect. The settlemnt of this case is done by using restrorative justice, namely VOM (victims offender mediatation) which is a meeting between the victims and the perpetrator led by a mediator.
