Abstract

The definition of marriage according to the marriage law is an inner and outer bond between a man and a woman with the aim of forming an eternal and happy family based on God Almighty. But every marriage does not go according to that purpose, sometimes it can end in divorce for certain reasons. That's the fact that happened in Tembilahan City, precisely in the jurisdiction of the Tembilahan Religious Court. Divorce cases are increasing every year. The main issues raised are How the process of settling iddah living in the Tembilahan Religious Court and How much iddah living is determined by the Tembilahan Religious Court. This research was conducted using empirical research methods that are descriptive analysis. So the researcher will conduct a direct survey of spaciousness. The location chosen to answer the problems in this thesis is the jurisdiction of the Tembilahan Religious Court. The researcher conducted interviews with judges, clerks and litigants and analyzed 3 Judgments. The method of drawing conclusions used is the inductive method, namely by combining specific postulates into the general. The divorce rate at jurisdiction of the Tembilahan Religious Court is quite high. The factors that are the cause of divorce are infidelity, leaving one of the parties, due to drunkenness, drunkenness and gambling, domestic violence, polygamy, the economy and most of all the factors of continuous disputes and quarrels. This reason is dominant because it is influenced by the weakened economic conditions of the family which causes complex problems and the couple is unable to cope with their feuds.
