Abstract

Law Number 8 of 1999 has the aim of providing protection, justice and legal certainty to consumers. This Consumer Protection Law also regulates prohibitions that should not be carried out by business actors. But in reality, the public's ignorance of this rule causes consumers to suffer losses as a result of adverse provisions made by business actors, as happened to consumers of the NyxBetta ornamental fish business where consumers do not receive compensation due to fish death before it reaches consumers, this is Of course, this is contrary to the Consumer Protection Act, where compensating for goods that are not suitable is the obligation of business actors. The problem examined in this study is how the ornamental fish business actors are responsible for fish deaths that occur during online transactions, and what are the legal consequences of ornamental fish business actors who are not responsible for losses incurred in online transactions based on Law Number 8 of 1999. The method used is observational research or empirical legal research, which is a method carried out by observing the practice of buying and selling ornamental fish with an online system and collecting related data through interviews and field observations, then the data that has been collected is processed to find a conclusion. The purpose of this study is to find out how the liability for consumer losses caused by the death of fish before it reaches consumers and what are the legal consequences for business actors who are not responsible for consumer losses. The results of this study are ornamental fish business actors refuse compensation to consumers who suffer losses due to fish deaths because they are not accompanied by unboxing videos, this is not in accordance with the Consumer Protection Act where business actors are required to compensate for losses arising from a transaction. Violation of Article 19 of the Consumer Protection Law can be subject to administrative sanctions with a maximum fine of Rp. 200,000,000, - but in practice consumers who are harmed prefer not to do anything when a complaint about compensation is rejected by a business actor because it is not accompanied by an unboxing video. and imposing a boycott on ornamental fish business actors who do not compensate.
