Abstract

The background of this research is that the government and the community carried out legal actions, changed ownership of land rights from certificates of ownership to become regional property, and given back to the community with the status of new land rights as a mutual agreement, but in practice what happened in the policy field issued by the government contradict the rules on land rights that will be given to the community in the form of usufructuary rights in accordance with the previous agreement, and the policy is contrary to Government Regulation (PP) Number. 18 of 2021 concerning Management Rights, Land Rights, Flats Units and Land Registration. From the above background, the authors formulate the main issues including: First, what is the Status of Land Rights Granted to the People of Simpang Kelayang Village, Kelayang District as Regional Property of Indragiri Hulu Regency?, Second, What are the Legal Consequences of Granting Land Rights to the People of Simpang Kelayang Village? Kelayang Subdistrict As Regional Property of Indragiri Hulu Regency? The type of research used in this research is research by way of a survey or going directly to the research location by using a data collection tool, namely interviews. While its nature is descriptive in nature, namely Juridical Analysis of the Ownership of Regional Property That Is Given Land Rights to the Community of Simpang Kelayang Village, Kelayang District, Indragiri Hulu Regency From the results of the research it is known that the Juridical Analysis of the Tenure of Regional Property That Is Given Land Rights to the People of Simpang Kelayang Village, Kelayang District, Kelayang Regency is not like the results of the previous (first) meeting, because regional property comes from changes in certificates of ownership rights and will be given rights use that should have been issued by the government turned into a Placement Right (SHP), so that the impact of changing the land title certificate was very detrimental to the community because the policies contained in the Placement Right (SHP) were only based on PERDA Kab.INHU No.03 of 2015 Jo. PERBUP Kab, INHU No.04 of 2016 Concerning Market Management, is very much in conflict with the regulations contained in PP No.18 of 2021 which regulates Management Rights, Land Rights, Flats Units and Land Registration.
