Abstract

Legal protection for casual daily workers means discussing the rights of workers/labourers after fulfilling their obligations. Until now, employers still perceive casual daily workers as vulnerable. At the same time, casual daily workers themselves do not know what their rights and obligations are. In other words, even though there is no more important party in a good partnership, casual daily workers comply with the rules set by the employer because employers and daily workers benefit from each other. The applicable labor regulations, Law no. 13 years, must be obeyed in implementing legal protection for casual daily workers. In this study the authors have the following main issues, How is the legal protection of casual daily laborers at the oil palm plantation company PTPN V Sei Garo, Tapung District, Kampar Regency in terms of Law Number 13 of 2003 concerning Employment and What are the legal remedies? Are daily workers free from labor relations disputes at the oil palm plantation company PTPN V Sei Garo, Tapung District, Kampar Regency. The research method used by researchers is Positive Research/Sociological Research, namely research that is equipped with empirical data, namely primary data using secondary data (from literature) and based on field studies such as observations, interviews and research supporting surveys. The nature of the research is contained in descriptive research, namely describing events in a certain area at a certain time, describing the initial data for the questions to be studied, especially those relevant to this title. The purpose of this research is to find out how casual daily workers at PTPN V Sei Garo, an oil palm plantation company in Tarpong District, Kampar Regency, have access to legal protection and legal remedies against labor relations disputes based on Law Number 13 of 2003 concerning employment. The results of this study are that the legal protection for casual daily workers who work at PTPN V Sei Garo is appropriate, but there are still a few problems, such as the absence of a written work agreement made between the contractor company and casual daily workers that this is contrary to Article 66 Law No. 13 of 2003 Concerning Employment, As well as the company's obligation to provide workers' rights has not been fulfilled, such as the problem of not registering all freelance daily workers with social security providers (BPJS) where this is also a company obligation that must be fulfilled, in accordance with the Regulations Current regulation.
