Abstract

A marriage is valid if it is carried out in accordance with trust and recorded in order to obtain legal protection for each party who carries it out and for the resulting children. But it becomes a problem for a child whose both parents do not marry as recommended by the provisions of the law and the government in terms of registering or carrying out a "siry marriage". If it is seen from what happened in Lubuk Siam Village, Kampar Regency, children resulting from unregistered marriages still do not get protection, especially in terms of inheritance from their fathers, because the child does not get recognition from his own family, and is not given money to continue his life. The main problem of the research is how to protect children's rights from Siri marriages in Lubuk Siam Village, Kampar Regency, and what are the obstacles in obtaining child rights protection from Siri marriages in Lubuk Siam Village, Kampar Regency. The research method is observational research type. Where research is carried out by survey or carried out by reviewing the research site by using interviews. while its nature is descriptive, that is, where the author describes in a clear and detailed manner the problems to be studied. The results of the study that the Protection of Children's Rights from Siri Marriages in Lubuk Siam Village, Kampar Regency is not yet implemented because it is difficult to provide protection even though children are protected by law because to protect children from unregistered marriages, the child must be able to prove himself as a child. the biological father of his father, where the mother herself must file a lawsuit to the Religious Court, by proving based on science and technology and/or other evidence which according to law has blood relations, including civil relations with her father's family. Due to the status of his mother who had an unregistered marriage, the child could not claim his inheritance rights, and Obstacles in Obtaining Protection of Children's Rights from Siri Marriages in Lubuk Siam Village, Kampar Regency are not having authentic evidence regarding the clarity of the child's whereabouts, lack of awareness from parties who have ties to the child's father, and no action from his mother to file a complaint. Proving that the child is the child of his biological father is due to the absence of fees, and it can be said that the proving process also requires a long process, because it must be proven based on science and technology or other evidence.
