Abstract
In buying and selling transactions on Instagram online media on average experienced by the buyer where the seller does not have any risk, after the money is received and the goods are sent, the goods that have been transported are no longer the responsibility of the seller, and also at the time of delivery the seller is not charged to carry out the confirmation process to the buyer even though the money has been sent by the buyer, so that it is very often misused by the seller who is not responsible and is in default of the buyer who wants the goods ordered to arrive and in the desired condition. The main problem in this thesis research is how to carry out buying and selling transactions if the seller defaults on Instagram online media and how is legal protection if the seller defaults on buying and selling transactions on Instagram online media The type of legal research method that the researcher uses is the Sociological Empirical research method is research that is used to describe the conditions seen in the field as it is and the nature of analytical descriptive research which is a study that seeks to provide an overview, namely by collecting data, analyzing and interpreting data. that exists precisely and clearly The results of the research that the authors found. Problems that are often encountered in online buying and selling agreements are usually prone to default. As happened in the "Mobile Buying and Selling Transactions Through Instagram Between Customers and Online Shop Accounts @Rumahgadgetpku" Defaults that occur in an agreement aim to not do an act. If the person does not fulfill the rights that he should have done, then the person can be said to be in default. The occurrence of a default can cause consequences or compensation that will be caused to the adverse party and will be addressed to the aggrieved party. And Consumers who use E-Commerce transactions get legal protection based on the provisions of the legislation, namely the Consumer Protection Law (UUPK Article 1 Number (1) and Article 4 c UUPK) and the Electronic Information and Transaction Law (Article 2 and Article 9 UUITE.
