Abstract

Auction is the sale of goods that are open to the public with written and or verbal price quotes that are increasing or decreasing to reach the highest price through efforts to gather interested parties / auction participants and must be led by auction officials, which is preceded by Auction Announcement. Auction at the Branch Office of PT Pegadaian (Persero) Pekanbaru Kota occurs because customers make defaults or break promises, namely customers of PT Pegadaian (Persero) Pekanbaru Kota are unable to repay loans along with other costs that have been promised. The main problem in this study is the Auction Implementation of Pawn Guarantee Items at the Branch Office of PT Pegadaian (persero) Pekanbaru City. The main problem is then put into several subproblems, namely: How the implementation of a mortgage guarantee auction at the Branch Office of PT Pegadaian (Persero) Pekanbaru City and What are the obstacles faced by PT Pegadaian (Persero) Pekanbaru City in carrying out the auction of pledged collateral. This research is a type of field research (observation) or empirical legal research and its nature is descriptive analytical. This research will be conducted by interviewing branch leaders, employees of PT Pegadaian (Persero) Pekanbaru Kota and customers of PT Pegadaian (Persero). This study uses a sociological legal approach, namely direct research on space. For data collection obtained from observation, interviews and questionnaires. The purpose of this study is to find out the implementation of the auction of pledged collateral and the obstacles in carrying out the auction of pledged collateral. Based on the results of these studies answered regarding the implementation of the auction of pledge collateral at the Branch Office of PT Pegadaian (Persero) Pekanbaru City has not been implemented properly and correctly because the auction of mortgage guarantees has not been in accordance with Minister of Finance Regulation Number 27 of 2016, namely the auction of pledged collateral carried out by PT Pegadaian (Persero) itself and not carried out by authorized auction officials. Whereas in the auction of pledge collateral at the branch office of PT Pegadaian (Persero) Pekanbaru Kota still has several obstacles such as a lack of understanding from the customer regarding the contents of the mortgage agreement made by PT Pegadaian (Persero) Pekanbaru City, the arrival of the notification letter to the auction the customer or the owner of the goods to be auctioned, there is no response from the customer or the owner of the pledge, the change in market prices for pledged collateral, the difficulty of PT Pegadaian (Persero) Pekanbaru City in selling the Auction Time Goods (ATG).
