Abstract

In general, vehicles such as motorcycles are full of users, but the same applies to used or used motorcycles. In the development of business, the importance of Consumer Protection is applied in accordance wit the applicable legal rules in the community with the Consumer Protection Act. This must be applied firmly in the business world because it will affect the emergence of problems in the future. These problems are the losses suffered by consumers, for example problems regarding the imperfect condition of the motorbike, hidden defects, and the absence of guarantees for consumer rights which lead to unlawful acts. The purpose of this research was carried out by raising the problem, namely regarding consumer protection against the sale and purchase of used motorbikes in Lubuk Dalam District and the second was the Dispute Resolution Process carried out by CV. Motorcycle Batteries with Consumenrs in the Sale and Purchase of Used Motorcycles in Lubuk Dalam District. This research uses empirical Sociological Law Research or a direct survey to the field, data collection tools in the form of interviews, and is descriptive. Data analysis used qualitative methods and deductive conclusions were drawn. Based on the research data, that there is a consumer guarantee in buying and selling used motorbikes contained in the contents of the Lease Purchase Agreement made by CV. Used Motorcycle Batteries in Lubuk Dalam District, the implementation is fully implemented. But there are still violations that occur so that there are acts that violate the law. Such violations, such as the lack of clarity in the information provided regarding the condition of the motorbike, this is related that have occurred between consumers and CV. Used Motorcycle Batteries in Lubuk Dalam District. There is a violation of the rights that consumers should receive as described in Article 4 of Law No. 8 of 1999 concerning Consumer Protection. So that the seller in carrying out his business, namely buying and selling used motorbikes, has committed actions that are prohibited for business actors in accordance with the provisions of Article 8 paragraf (2) of Law Number 8 of 1999 concerning Consumer Protection. With the existence of a consumer guarantee stated in the sale and purchase agreement, business actors are obliged to carry out their responsibilities by compensating for losses suffered by consumers in accordance with the provisions of Article 19 of Law Number 8 of 1999 concerning Consumer Protection. Based on the whole case, the dispute resolution process that occurs between the seller and the consumer can be resolved peacefully or out of court (Non-Litigation).
