Abstract

Sumatran elephants are endangered species that have been regulated in Law Number 5 of 1990 concerning Conservation of My Natural Resources and Ecosystems, thus elephants may not be hunted, captured, and killed in order to maintain their sustainability. However, so far after the enactment of the law on animal protection, in the Indragiri Hulu District, Cases of Sumatran Elephant Murder are Still Found in the Bukit Tiga Puluh Protected Forest. This study aims to find out what are the factors causing the criminal act of killing Sumatran elephants in Indragiri Hulu district, what is the modus operandi used by the perpetrators of the crime of killing endangered animals and how to overcome the crime of killing endangered animals. The method used by the author in this study is the legal observational research method, namely by surveying or observing directly to the research location using data collection tools, namely interviews with Rengat District Court Judges, Indragiri Hulu Police Criminal Investigation Unit, Head of Class II B Rengat State Detention Center, and Head of BBKSDA Riau Province. And the defendant in the Sumatran elephant murder case, while the nature of this research is descriptive, namely the author tries to provide a detailed description. Namely, to describe the problems found to be related to each other in a logical and juridical way to get a clear and detailed picture of the factors, modus operandi and efforts to overcome the crime of killing endangered animals. From the results of the study that the factors causing the criminal act of killing Sumatran elephants in Indragiri Hulu district were economic factors, hunting, trading of body parts (elephant ivory) while the modus operandi used by perpetrators of the crime of killing endangered animals, shooting, killing, selling conventionally or social media. And efforts to overcome the crime of killing endangered animals are carried out in a penal and non-penal manner.
