Abstract

Embezzlement is included in the section of crimes regulated in the Criminal Code (book two) Articles 372-377. Embezzlement belongs to the type of crime against property. Crimes that occur in social life are a phenomenon that continues to be in the spotlight. The onset of embezzlement, then, is inseparable from the causes of the crime itself. The main problem in this study is how the application of material criminal law in the criminal act of embezzlement in the position of Number; 20/Pid.B/2022/PN.Pbr and how the panel of judges considers in rendering a verdict on the criminal case of embezzlement in office No. 20/Pid.B/2022/PN.Pbr. This research is included in normative sociology, namely by dissecting case decisions, books, etc., which are related to the title of the study, while the nature of this research is Descriptive Analysis, which provides an overview of the formulation of the problem. From the results of this study, it can be seen that, the sentence of imprisonment in judgment Number;20/Pid.B/PN.Pbr for 1 year and 10 months against the defendant was not in accordance with the applicable laws and regulations because previously the defendant had met with the complainant and had been resolved in a familial manner by paying a certain amount of compensation in the form of 1 unit of car, one unit of house, account book, atm along with his pin and the defendant is willing to be deducted salary to cover the remaining losses suffered by corporate.
