Abstract

The obligation imposed by the seller to deliver the product to the buyer or in the COD payment method the courier is required to meet directly with the buyer to make a transaction by receiving payment in reality does not go well. The existence of a buyer who refuses to pay for the goods ordered and sometimes coupled with taking personal attacks from the courier will cause material and in material losses from the courier. The main problem in this research is how is the legal protection of couriers in e-commerce transactions with the Lazada COD (Cash on delivery) system in the city of Pekanbaru, and how is the legal position of the courier in e-commerce transactions with the Lazada COD (cash on delivery) system in the city of Pekanbaru. The research methods used in this study are: Observational research which was conducted by means of a survey, namely direct research to the research location using data collection tools in the form of interviews. And the research is descriptive, which provides a clear and detailed description of the main problem under study. Law No. 13/2003 concerning Manpower and Law No. 11/2020 concerning Job Creation only regulates occupational health and safety, which are directly related to their work and not potentials that arise from third parties. And the legal protection that can be given to couriers in the COD online shopping system is to guarantee that discrepancies or errors in the goods ordered are not the responsibility of the courier, if this is not caused by the courier's error or negligence, as regulated in Article 1708 of the Civil Code, Courier Position as regulated in Articles 1694 – 1739 of the Civil Code concerning the safekeeping of goods. In addition, as someone who receives payment from the buyer to be forwarded to the seller, it is regulated in Article 1382 - 1456 of the Civil Code concerning payments. Legal protection that can be given to couriers in the online shopping COD system is regulated in Article 1708 of the Civil Code.
