Abstract
Humans were created by God perfectly and endowed with various advantages. Therefore, as creatures that have more character and mind than other creatures, humans try to overcome feelings of insecurity. Humans work with their minds to overcome insecurities in order to feel safe. Through this effort, humans try to move from uncertainty to certainty so that they can overcome or prevent risks individually and collectively. Insurance or coverage is an institution that is willing to bear the risk of other people entrusted to it. Article 251 of the Criminal Code requires reporting of all conditions known to the insured regarding the insured object. But in fact there are still violations in the form of storing health information about the insured either intentionally or unintentionally. The formulation of the problems raised in this study are: 1) How is the application of the principle of utmost good faith in the health insurance agreement at PT. Prudential Life Assurance Pru Future Team Pekanbaru 2) What are the legal consequences for the insured when he does not apply the principle of utmost good faith in the health insurance agreement at PT. Prudential Life Assurance Pru Future Team Pekanbaru.. The research method used in this study is an empirical research method. This research uses the type of sociological juridical research. The data sources used are: primary and secondary data sources. Methods of data collection in the form of: interviews, documentation and literature study. Based on the research results show that: the application of the principle of utmost good faith in health insurance at PT Prudential Life Assurance Pru Future Team Pekanbaru, namely that there are still insureds who do not apply the principle of utmost good faith, namely by not telling complete facts about the situation or the insured being less thorough in conveying important facts related to the insured object. In Article 251 of the Criminal Code it is stated that "all false or untrue reporting or concealment of circumstances known to the insured, however honest it happened on his part, is of such a nature that the agreement will not be held with the same conditions if the insurer knows the circumstances actually from that thing, causing the insurance to be void." Legal consequences for the insured when they do not apply the principle of utmost good faith in the health insurance agreement at PT Prudential Life Assurance Pru Future Team Pekanbaru in accordance with the provisions of Article 251 of the Criminal Code and the general provisions of the policy, the claim submitted by the insured cannot be approved and rejected.
