Abstract

Adoption is a situation where someone takes over someone else's child and the child will be treated like their own child (biological child). It can happen additionally in the Chinese ethnic community in Lima Puluh district, Pekanbaru, as a way to continue their descent or for other reasons. This can lead to legal laws, one of them is division of inheritance. The problems raised in this research are the first regarding, adopted children and how the legal rules are enforced by the ethnic Chinese community in Lima Puluh Kota Pekanbaru and the second regarding, the distribution of inheritance to the adopted child. The research method chosen by the author in this study is to use the type of Field Research, Juridical Empirical (Qualitative), and to strengthen the data, uses Library Research. In addition, this study is assisted by four respondents as a sample Purposive Sampling through interviews, observation and documentation. To explain the conclusions, this study uses an inductive method. Regarding the results of the research and discussion that the author found: First, the position of ethnic Chinese children in the Lima Puluh District, Pekanbaru, still uses lineage from the father's side (Patrilineal). This causes some of the people who do not have children, will adopt children, especially for sons who aim to be the successors of the clan or holders of ancestral ashes. Second, for the position of the adopted child, there is no special treatment or distinction from biological children. However, in terms of inheritance, adopted children, especially sons, may benefit more when the child is legally adopted and has strong evidence in the event of a violation of the law. It is even possible for adopted children and biological children to get equal rights, returning to the family agreement.
