Abstract

The Social Security Implementation Agency or commonly known as BPJS is a Public Legal Entity that works to strive for National Health insurance for all Indonesian people. BPJS issued the JKN mobile application to make it easier for people to register themselves more easily. However, in the running of the application issued by BPJS, there are still many things that have not been notified in detail by the government to the general public. The main problem in this research is how the implementation of the BPJS Agreement with Participants at the YLPI Pratama Clinic Pekanbaru and whether the contractual agreement has fulfilled the principle of freedom of contract. In this study using Sociological or Observational legal research methods, which are analytical in nature, while for data collection tools the authors use are using interviews and questionnaires with respondents related to the implementation of this BPJS agreement. The implementation of this BPJS agreement when viewed from two sides, namely the BPJS side and the community side, the implementation is not going well, which from the BPJS side itself does not really tell anything about JKN mobile on a large scale to the community. Not to mention, the agreement made is more general. Then the community also, did not find out about anything about BPJS. However, if examined more deeply based on the author's analysis, the BPJS agreement to BPJS cardholders is not in accordance with the Law which causes the agreement to be invalid and can be canceled by law. Obstacles in the community who follow BPJS as health insurance, they do not know about the application that has been issued by BPJS itself, namely JKN mobile. Even though JKN mobile itself can make it easier for people to do treatment more easily.
