Abstract

The more developing science and technology, the more the methods used in the buying and selling process are also developing. Starting from a barter system that is done by exchanging goods face to face, developed into a sales system using a wider range of internet networks. The process of buying and selling through the internet is often referred to as buying and selling online. This transaction is contained in electronic media (digital media) which physically does not require a meeting of the parties conducting the sale and purchase online. Social media that is loved by the public at this time is Instagram. Instagram is an image based application with hundreds of millions of users worldwide. This application can be used for various activities. One of them is conducting online buying and selling activities. One instagram user who conducts online trading transactions is @alwafahijab. Online sale and purchase transactions are new types of transactions where specific arrangements have not been described in the Civil Code, but are regulated in Law number 19 of 2016 concerning Information and Electronic Transactions. In this study, the authors formulated the main problems discussed regarding how the implementation of online trading transactions based on Act Number 19 of 2016 concerning Information and Electronic Transactions on the instagram @alwafahijab online shop account and the obstacles encountered in implementing online buying and selling transactions based on the Law Act Number 19 of 2016 concerning Information and Electronic Transactions on the instagram @alwafahijab online shop account. This research is an observational research that is research by survey. The nature of the research in this study is descriptive for research that aims to describe the legislation, associated with the theory and practice of implementing positive law, which concerns the problem under study. The implementation of online buying and selling transactions based on Act Number 19 of 2016 concerning Information and Electronic Transactions on the instagram @alwafahijab online shop account is already running in accordance with the good faith principles stated in Article 17 number 2 of Act Number 19 of 216 concerning Information and Electronic Transactions. The principle is an obligation carried out by the parties that carry out the transaction of buying and selling online. The obstacles faced in the implementation of online trading transactions based on Act Number 19 of 2016 concerning Information and Electronic Transactions on the Instagram online shop account @alwafahijab is the delay in the time of delivery of goods to consumers which causes the producer namely @alwafahijab to default and cause consumer dissatisfaction as well as costs shipping goods that are quite expensive because shipping is done from the city of Pekanbaru to all regions in Indonesia.
