Abstract

Efforts that are an alternative to overcome unemployment and scarcity of employment opportunities are by placing workers abroad. Placement of labor services abroad with a mechanism that has been regulated through the Indonesian Ministry of Manpower and Transmigration Regulation Number: PER-19 / MEN / V / 2006 concerning the implementation and protection of Indonesian Workers Abroad, the Minister of Manpower Decree is considered as wrong an effective effort to overcome this problem. The current condition of the placement of workers abroad is still dominated by workers in the informal sector, especially household loans (PLRT) often also called female workers (TKW). However, sending PMIs abroad does not contribute a little to the country. The formulation of the problem in this study which is the study is. How is the legal protection of Indonesian workers domiciled in Malaysia and Obstacles to the Protection of Indonesian Labor Law Domiciled in Malaysia. The author conducts research using observational research methods, namely directly down the field to collect the data needed related to the research conducted. By conducting interviews with relevant parties in this study. Materials obtained from primary data are processed then compared with secondary data and conclusions are drawn and described descriptively and analyzed qualitatively. The results of the study concluded as follows: Legal protection for PMI rights at work has not gone well, lack of guidance on the legal meaning of PMIs, this has made it difficult for PMIs and eliminated the sense of security for PMI while abroad. The obstacle in implementing legal protection against PMI is that there was a mistake made by PMI, namely not reporting the problem to the Indonesian government at the place of migrant workers working, education owned by PMI was still low. BP3MI seeks to hold the PMI job fair, which is expected to be a vehicle of communication between job seekers and PMI distributor companies. This effort aims to minimize errors that result in losses during the placement and distribution of PMI.
