Abstract

Soil is a part of the earth that cannot be separated and is defined as the surface of the earth or the top layer of the earth. Land is also a major factor in aspects of life and is constitutionally formulated in Article 33 Paragraph 3 of the 1945 Constitution which reads as follows: "Earth, water and the natural resources contained therein are controlled by the State and used as much as possible for the prosperity of the people." The formulation of the problem in this research is first, what is the process of resolving land disputes through mediation of two certificates of land rights in one land object in Pedamaran Village, Pekaian District, Rokan Hilir Regency? And secondly, what are the inhibiting factors in resolving land disputes through mediation of two land certificates in one land object in Pedamaran Village, Rokan Hilir Regency? This research uses Sociological legal research methods (empirical) or observational (observational research) which are descriptive analysis in nature by collecting data using interview and survey techniques. The location chosen to carry out this research was the Pedamaran Kepenghuluan (Pekait) Bagan Siapi-Api, Rokan Hilir Regency. The result of this study is the Settlement of Land Disputes Through Mediation Against Two Land Rights Certificates in One Land Object in Pedamaran Village, Pekaian District, Rokan Hilir Regency, which consists of 2 factors, namely: the Pedamaran Penghuluan party, and the certificate holder. Obstacles in carrying out the Dispute Resolution Process Through Mediation Against Two Land Rights Certificates in One Land Object in Pedamaran Village, Pekaian District, Rokan Hilir Regency is because one party cannot be present in carrying out the mediation, while other factors, namely before the mediation was carried out, both parties were still defend their respective rights, without any settlement by mediation, then the next factor that becomes an obstacle is because this case has been discussed for a long time until only now both parties have made a settlement by mediation.
