Abstract

Mining activities is a business activity related to mineral and coal which including several steps such as general investigation, exploration, feasibility study, construction, mining, processing and purification, transportation and sales as well as post mining activities. This research analyzing the investment climate of mining business in Indonesia since establishment of the Government Regulation (PP) No.24 of 2012 concerning the implementation of mining, mineral and coal business as well as the Regulation of the Minister of Energy and Mineral Resources (ESDM) No.7 of 2012 concerning the enhancement of mineral value through mineral’s procession and purification (smelter). This research can be categorized as normative-juridical research. Government has established PP No.24 of 2012 which contained statement that mining companies may commit export of mineral substance (ores) to anywhere overseas prior to January 2014 and as long as they hold the recommendation of the ESDM minister. According to letter of cooperation request on mines and minerals of the Directory of mining and industry export (Ditjen Daglu) No. 1022/DAGLU.S.4/ND/S/2015 dated August 15, 2015. It stated that the International trade policy center will conduct an evaluation related to export ban of raw materials or ores.
