Abstract

Credit that has been given by the bank as the creditor to the customer as the debtor is not always of good quality or commonly referred to as problem credit, this non-performing credit is a form of default in which the debtor has broken a promise to repay the debt to the bank either partially or wholly that has been maturity, so that thus the debtor is no longer able to pay his debts to the creditor, which is the cause of this credit problem coming from both parties, namely the customer or the bank PT Bank Riau Kepri marpoyan Pekanbaru which has customers whose credit is in trouble from January to December 2021 as many as 141 people who are classified as Non Performing Loans (NPL) from 9.754 customers who enter into credit agreements. As for the formulation of the problem in this writing, the first is that the author wants to know about what are the factors that cause problem loans and to find out how the process of solving problem loans is based on law number 10 of 1998 concerning banking at PT Bank Riau Kepri, marpoyan shop, Pekanbaru, while this type of research is observational research or survey research by collecting from respondents using two types of data, namely primary data and secondary data. The nature of this research is descriptive which describes the facts that occur in the field. Factors for the occurrence of non-performing loans based on Law Number 10 of 1998 concerning Banking at PT. Bank Riau Kepri Kedai Marpoyan Pekanbaru can occur from the bank (creditor) and from the customer (debtor), among others, not being transparent and non-cooperative, not open and honest, so that the bank is difficult to obtain information about the growth and development of the customer's business. In addition, factors that also influence are customers not paying their obligations on time and declining economic conditions. The process of resolving non-performing loans Law Number 10 of 1998 concerning Banking at PT. Bank Riau Kepri Kedai Marpoyan Pekanbaru has 2 (two) stages, namely the credit rescue stage and the credit settlement stage. The credit rescue stage is through the collection and restructuring of credit by the bank, namely by lowering loan interest rates, extending credit terms, or adding credit facilities. Meanwhile for loans that cannot go through the rescue stage, a settlement stage will be carried out through the confiscation of collateral or the confiscation of collateral which is carried out, especially guarantees with mortgages that can be sold under the hands or by the State Property and Auction Service Office (KPKNL), Debt Transfer (Subrogation, Novation, and Cassie) and write offs.
