Abstract

The process of implementing traditional marriages in Rokan Hulu Regency still adheres to and upholds customary law traditions, especially for the Mandailing community, one of whom is surnamed Nasution. However, due to the fact that at this time there have been developments and changes to more modern thought, some of the indigenous people of the Nasution clan association do not practice what is customary in the implementation of traditional marriages, so this has led to the disappearance of the customary law tradition in the Mandailing community. The main problem of the study is how the implementation of customary marriages at the Nasution clan association in the Rambah Tengah Barat subdistrict, Rokan Hulu district, and how the legal consequences of marriages carried out according to customary law and not carried out according to customary law at the Nasution clan association in the Rambah Tengah Barat district, district Rokan Hulu. The research method is a type of legal research, observational research or survey, while its nature is descriptive, that is, where the author describes in a clear and detailed manner the problems to be studied. The results showed that the implementation of traditional marriages at the Nasution Marga Association in the Rambah Tengah Barat District, Rokan Hulu Regency was carried out with several processes, namely the approach of the male party to the female party to carry out the application (Susulu aek / manyapai boru), After the application was received then notification was made. to the man on the receipt of the application (padamos hata), followed by the approval of the application by holding a meeting of the two parties (patobang hata), by marking the woman paying the honest money until the wedding is carried out, then a thanksgiving ceremony or reception accompanied by the tor-tor dance is held. . However, there are still those who do not carry out this implementation due to an agreement between the two families, especially in terms of paying honest money because it will burden women due to a difficult economy. The legal consequences of marriages carried out according to customary law and not carried out according to customary law at the Nasution clan association in the Rambah Tengah Barat sub-district, Rokan Hulu Regency, are marriages carried out under customary law will get customary recognition so that when a problem arises in the family, either in the form of quarrels or divorces, then adat is the first to resolve them, but if the marriage is not carried out according to customary law then if a problem arises then adat people such as the adat parent cannot intervene to resolve it.
