Abstract

Restorative justice in cases of minor crimes as an alternative to a win-win solution that protects victims and perpetrators, to avoid the bad effects of the criminal justice system and the criminal justice system which has been and more importantly can reduce the number of cases to simplify the judicial process. Based on this phenomenon, the writer is interested in discussing the implementation of restorative justice in cases of minor crimes at the Kampar Police with the main problem: How is the implementation of restorative justice in cases of minor crimes at the Kampar Police? What are the factors that hinder the implementation of restorative justice in cases of minor crimes at the Kampar police station? The research method used to obtain data that can later be scientifically justified. The type of research that will be used in this research is Empirical Research. While the nature of this research is descriptive analysis which reveals the laws and regulations relating to legal theories that are the object of the researcher. Where the authors use primary data sources and secondary data and conduct interviews with respondents to obtain data sources regarding the implementation of restorative justice in cases of minor crimes at the Kampar police station. The results of the study show that the implementation of restorative justice in cases of minor crimes at the Kampar Police can only be done if the victim and the perpetrator request a settlement of the case through restorative justice. It is from this request that the police as investigators can carry out restorative justice for mediation efforts that act as mediators from both parties. The inhibiting factors experienced in the implementation of restorative justice for minor crimes by the Kampar Police include the legal factor itself (including the law), law enforcement factors, facilities and facilities that support law enforcement, community factors, namely the community where the law is applied. and Structure of Police Institutions.
