Abstract

It must be admitted that along with the development of the times, it has indirectly changed people's lives, especially when the Covid-19 outbreak is endemic in people's lives, which has made people's lives now done online, especially in buying and selling because its use is efficient and easy, but in practice there is a problem, namely regarding legal uncertainty which is guaranteed because the parties involved do not meet directly so that it is very difficult to determine the identity of the parties so that it does not rule out the possibility of default or fraud The formulation of the legal problem in this research is 1. How is the validity of buying and selling transactions through E-Commerce in civil law and 2. How is the protection of the parties involved in buying and selling through E-Commerce. The method used to answer the problems discussed is data collection carried out by library research, where the data comes from books or from library sources, both primary and secondary which are analyzed qualitatively by drawing conclusions by deductive. The results of this study are that in buying and selling transactions through E-Commerce it is said to be valid if an agreement has been born between the parties who make and follow the rules in Article 1320 of the Civil Code. If in its activities the parties involved are not legally capable or underage, as long as that party maintains the principle of good faith and is responsible for his actions while not harming the other party, the agreement is still valid. For the protection of the parties who are harmed due to buying and selling through E-Commerce, they can sue through litigation or non-litigation, such as mediation, which if there is no bright spot, it can be continued in court.
