Abstract

Communal intellectual property should be protected for several reasons, including to increase the economic benefits of the community, to create justice in the world trade system and to protect the rights of local communities. Nowadays there are many cases of works owned by a group of people without knowing who the creator is, even though these works have economic value that can be commercialized by a group of other people which can cause losses on the part of the original owner community. The problem of this research is how is the role of the government in implementing the legal protection of communal intellectual property to increase MSMEs in Riau Province, and what are the obstacles in implementing the legal protection of communal intellectual property to increase MSMEs in Riau Province. The research method is observational research by means of a survey, meaning that the researcher directly conducts research at the location of the research place, while its nature is descriptive. The results of the research and discussion show that the role of the government in implementing legal protection for Communal Intellectual Property to increase MSMEs in Riau Province has been carried out in the form of socialization by the Regional Office of the Ministry of Law and Human Rights and has also appealed to the ranks of the provincial government and district governments to participate in the KIK inventory but because it is still the lack of legal rules that regulate especially there are no regional regulations that specifically regulate both in Traditional Knowledge and Cultural Expression so that the increase in MSMEs has not been going well. Obstacles in the implementation of legal protection of communal intellectual property to increase MSMEs in Riau Province are regulations that do not fully support the implementation of communal wealth in the type of traditional knowledge, the low awareness of business actors to register their work or ideas and the lack of socialization from the government to register communal rights. . However, the ratification of the PTEBT Bill is also an ongoing obstacle for KIK legal protection and other obstacles, the lack of knowledge and awareness of MSME actors to register their products, it is difficult for the government to realize in protecting other communal assets.
