Abstract

Currently, Indonesia's forests and lands are experiencing serious damage. The damage that occurred was in terms of management, illegal logging and even more worrying was the burning of forests and land by forest and land processing companies or by the community. Environmental law provisions in Law no. 32 of 2009 for example, contains provisions or legal norms relating to rights, obligations and authorities in environmental protection and management. From the above background, the authors formulate the main problems including: First, How is the Implementation of Law Enforcement on Forest and Land Fire Crimes Judging from Law Number 32 of 2009 (Case Study of the Siak Police District Legal Area)? Second, What are the Obstacles in Law Enforcement The Crime of Forest and Land Fires Judging From Law Number 32 Year 2009 (Case Study of the Siak Police District Legal Area)?. Judging from the type, this research can be classified as Sociological Empirical research, namely research conducted by survey, namely research directly to the research location using data collection tools in the form of interviews. While the nature of this research is descriptive, that is, it provides a clear and detailed description of the problems that are the subject of research. After going through the process of data collection and data processing, then the data is analyzed based on qualitative methods, then after the data is analyzed, conclusions are formulated inductively, namely drawing conclusions from specific things to general. From the results of the study, it can be concluded that the enforcement of criminal law against perpetrators of forest and/or land burning in the jurisdiction of the Siak Resort Police is in particular the Special Criminal Investigation Unit of the Resort Police Criminal Investigation Unit (Polres Siak) has conducted an investigation of suspects who have been arrested and detained by the Special Criminal Unit Investigators. Siak Police Satreskrim. Inhibiting factors for the enforcement of criminal law against perpetrators of forest and or land burning in the jurisdiction of the Siak Resort Police are legal factors or laws in which the cases investigated by the Siak Police Satreskrim Pidsus Unit apply the criminal provisions in the Criminal Code, not the criminal provisions in the law. special laws such as the Law on Environmental Protection and Management, the Forestry Law and the Plantation Law.
