Abstract

The Supreme Court's decision Number 57/Pdt.Sus-HKI/Brand/2019 is a decision regarding a trademark dispute between Ruben Samuel Onsu and Benny Sujono on the object of the dispute over trademark rights ownership. Dispute over the ownership of the trademark rights occurred between Ruben Samuel Onsu and PT Ayam Geprek Benny Sujono. There are similarities in essence, causing bad faith. Weaknesses and shortcomings in the Supreme Court's decision Number 57/Pdt.Sus-HKI/Merek/2019 explains that the trademark registered by Benny Sujono first obtained a trademark rights certificate than the Bensu trademark registered by Ruben Samuel Onsu. So that in the decision the judge rejected the demands put forward by Ruben Samuel Onsu and stated that the "Bensu" brand in "I Am Geprek Bensu Sedep Beneerrr" first got the certificate of ownership of the bensu registered first. The problem in this research is how the ownership rights in the Supreme Court Decision Number 57/Pdt.Sus-HKI/Merek/2019 are reviewed from Law Number 20 of 2016 concerning Trademarks and how the ownership rights are in the Supreme Court Decision Number 57/Pdt.SusHKI/ Brand/2019. The type of research used is normative law research with related research approaches such as legislation approach, case approach and conceptual approach. In collecting legal materials using library research techniques related to the problems that the authors examine. The results of the first study, namely Ruben Samuel Onsu, were proven to have had bad faith by admitting ownership of the brand containing the name "Bensu" from PT Ayam Geprek Benny Sujono, where PT Ayam Geprek Benny Sujono had registered the trademark for the first time (first to file) in accordance with the principles of the law. The judge's consideration in the judgment of the trademark used by the other party according to the law. No. 20 Of 2016 Concerning Brands And Geographical Indications based on decision No. 57/Pdt.Sus-Merek/2019/PN Niaga Jkt.Pst can be seen when the judge stated in his ruling that the brand name "I am Geprek Bensu" of PT Ayam Geprek Benny Sujono Geprek Bensu for the holder Ruben Samuel Onsu clearly imitated the brand based on the Explanation of Article 21 paragraph (1) of the MIG Law.
