Abstract

In Law Article 1 Number 1 of 1974 concerning Marriage, it is stated: "The inner and outer bond between a man and a woman hereinafter referred to as husband and wife with the intention of forming a happy and eternal family (household) based on the One Godhead. In the Compilation of Islamic Law verse 2, it is stated that marriage must maintain the existence of Muslims. Marriage is a sacred matter and one part of the miitsqan ghalidhan contract, is a good matter in accordance with Allah's commands that must be obeyed and the maintenance of marriage involves worship in Muslims. The problems in this research are as follows: First, how is the implementation of the marriage of pregnant women outside of marriage in Tanjung Permai Village, Kampar Kiri Hulu District, Kampar Regency. Second, what is the view of Islamic law on the marriage of pregnant women outside of marriage according to Islamic law. The type of research used by the author in this study is empirical legal research, namely the type of legal research carried out by analyzing and examining a problem directly, either by interview or by making an observation. Meanwhile, the nature of this research is descriptive analytical research, which is a descriptive study which means research that describes certain objects and explains things related or systematically describes facts or characteristics of certain populations in a particular field carefully. The research location is in Tanjung Permai Village, Kampar Kiri Hulu District, Kampar Regency, Riau Province The results of the research and discussion are as follows: First, the marriage process for pregnant women outside of marriage in Tanjung Permai Village, Kampar Kiri Hulu District, Kampar Regency, Riau Province is Negotiation Niniak Mamak between Tribes, then after the child is born and has reached the mass of Iddah, then they are married. . in which case there will be a derrah process that must be passed by both parties, then the marriage is repeated. Second, the view of Islamic law on the marriage of pregnant women outside of marriage is seen from several factors, namely, the perpetrators of pregnant women outside marriage, the families of the perpetrators of pregnant women outside marriage, traditional leaders in Tanjung Permai village, Kampar Kiri Hulu district, and the Indonesian Ulema Council (MUI).
