Abstract

Dynamics are social changes that occur in society in various forms and are caused by various conditions and situations. The implementation of Qanun number 6 of 2014 concerning Jinayat Law in Bireuen Regency has undergone several changes and reforms since it was formed until now, this is because the previous Qanun is no longer effective or is not in accordance with the times. The purpose of this study is to find out how the Qanun Jinayat is implemented in Bireuen Regency, and whether this Qanun Jinayat has been effective in minimizing Jinayat violations that occurred in Bireuen Regency. The problem with this thesis is that the implementers of this Qanun do not have the same understanding of this Qanun so that there are multiple interpretations in its implementation, besides the 'Uqubat applied to the perpetrators of Jarimah does not provide a deterrent effect so that the Qanun becomes ineffective. The type of research in writing this thesis is a qualitative research method where this research is an interpretive research (using interpretation) which involves many methods, in examining the research problem. The technique of collecting data is by using observation techniques, namely research conducted by taking data - data taken in the form of notes and documentation and direct interviews. Several informants related to the discussion of this research. The research subjects are the Head of the Regional Legislation Enforcement Division, Wilayatul Hisbah, Bireuen Regency, Sharia Court Judges, and Members of the Bireuen Regency People's Representative Council (DPRK) according to the overall respondent's response, which is in the good category according to the overall respondent's response. is in the fairly good category. As for the factors that hinder the implementation of the implementor's lack of understanding of the policies that are being implemented so that when socialization is carried out the information distributed is also diverse, besides that in the implementation of this Jinayat Law the government can be said to be less firm, this can be seen from several cases that are still repeated from this it can be seen that the sanctions given are less able to provide a deterrent effect on the perpetrators of Jraimah.
