Abstract

The Minangkabau community adheres to a matrilineal system of attracting descendants from the mother's line, the customary law of customary inheritance, one of which regulates high inheritance, high inheritance is passed on to daughters, the withdrawal of lineage from the mother can result in social inequality between men and women The main problem in this study is how to regulate customary law regarding the position of sons in obtaining inheritance rights on high inheritance and how to resolve the legal problem of high inheritance land tenure for boys in obtaining inheritance rights in Kenagarian Pangian. The type of research used in this study is observational research, which is a direct survey of the field using interviews and questionnaires as a data collection tool, and then based on its nature, this research is descriptive in that the author provides a clear and detailed description. Based on the results of research conducted by the author, the position of property ownership is collective/together, cannot be pawned or sold, boys get a title/sako and women get material rights, Settlement of high inheritance law is completed in stages, in the first stage it is completed by ninik Mamak, if it is not finished, it can be completed at the Nagari Customary Density.
