Abstract
Children are buds, potentials, and the next generation of the ideals of the nation's struggle, have a strategic role, and have special characteristics and characteristics that ensure the continuity of the existence of the nation and state in the future. However, often children become victims of a criminal act of exploitation. To follow up on matters relating to children as victims of criminal acts, in this case, victims of economic and sexual exploitation, children must receive special protection as regulated by Law no. 35 of 2014 concerning amendments to Law no. 23 of 2002 concerning Child Protection. Identification of the problem in this research, namely what are the forms of legal protection for children who are victims of economic and sexual exploitation in the case and how are the obstacles in obtaining legal protection for children who are victims of economic and sexual exploitation in case No. 1116/PID.SUS/2019/PN.PBR. When viewed from the type of research, the writing of this thesis uses the method of observational research, which is also included in the sub-section of sociological research. In this case, the writer went directly to the field to obtain and collect data through direct interviews. The nature of the research in this thesis is descriptive, namely by describing research in a clear, detailed, and systematic manner regarding the forms of protection for children who are victims of economic and sexual exploitation as well as obstacles in obtaining legal protection for children who are victims of economic and sexual exploitation in Case No. 1116/PID.SUS/2019/PN.PBR. From the results of the research, it is known that the form of legal protection for children victims of economic and sexual exploitation is by Article 59a, Article 59 Paragraph (1), and Article 66 of Law no. 35 of 2014 concerning amendments to Law no. 23 of 2002 concerning Child Protection. Furthermore, the form of legal protection that has been implemented is to provide protection to victims from threats and intimidation from perpetrators during trials and to impose maximum penalties on perpetrators of economic and sexual exploitation. Meanwhile, the obstacles in obtaining legal protection for children who are victims of economic and sexual exploitation are the lack of attention from the government, local governments, social organizations, and community institutions in fostering and protecting children who are in trouble with the law.
