Abstract

the practice of buying and selling, many goods are found to be in bad condition or have hidden defects either known or unknown to the seller. CV. Lestari Mandiri Sukses distributor as a business actor certainly has an obligation to guarantee two things, namely objects that are sold safely and peacefully and secondly against any defects in the goods that are hidden to the buyer. The problem is the result of purchasing goods that contain hidden defects where 9K Supermarkets cannot use or utilize these goods properly and there is no goodwill from CV. Lestari Mandiri Sukses distributors to be responsible for goods that have been sold to 9K Supermarkets. The formulation of the problem in this study is, First, how is the implementation of the responsibility of CV. Lestari Mandiri Sukses distributors in terms of hidden defects in consumer goods products received by 9K supermarket retailers. Second, how to resolve the dispute between CV. Lestari Mandiri Sukses and 9K Swalayan retailers over hidden defects in consumer goods products received by 9K Swalayan retailers. The type of research that the author uses in this study is the empirical research method, namely research conducted by means of field studies with the aim of obtaining a number of data (Observational Research). Meanwhile, judging from its nature, this research is descriptive analytical. Data collection techniques that the author uses are interviews and observation. While the method of drawing conclusions that the author uses in this study is the deductive method. From the results of research and discussion that the authors found are as follows: First, the implementation of product obligations and responsibilities by CV. Lestari Mandiri Sukses distributors to 9K Supermarkets retail in buying and selling transactions is not in accordance with the provisions of Article 19 and Article 7 of Law no. 8 of 1999 concerning Consumer Protection and Article 1504 of the Civil Code. CV. Lestari Mandiri Sukses distributors does not pay attention to its responsibilities related to hidden defects in goods that have packaging defects. Second, the result of dispute resolution by both parties is a refund from the distributor CV. Lestari Mandiri Sukses to 9K supermarket retail for Rp. 500,000,-. The distributor did not provide compensation equivalent to the losses suffered by the 9K Supermarket retail not in accordance with the provisions of Article 19 paragraph 2 of Law no. 8 of 1999 concerning Consumer Protection.
