Abstract

An agreement basically starts from inequality or there are differences in the needs and interests that the related parties want. In the agreement or contract, people really want to keep up with universal principles that apply in the law of contact, which is called the principle of freedom of contract. The cooperation agreement is still very much needed because it is accepted by each party who makes or makes an agreement. Every agreement made is always assumed that the position of the parties is equal or equal without any difference in making the agreement, but the reality is always different in terms of one's knowledge of the contents in the agreement. The main problem of this research is how the implementation of the sales and transportation agreement for fuel oil between PT. Bumi Laksamana Jaya with CV. Cahaya Silva and what are the obstacles in the implementation of the sales and transportation agreement of fuel oil between PT. Bumi Laksamana Jaya with CV. Cahaya Silva. The method used in this research is field research, which is research that goes directly to the field to collect data that is in accordance with the reality that occurred in the place where the author conducted research and obtained information that is not widely known. While the nature of this research is descriptive analytical meaning that this research aims to describe carefully the characteristics of the facts (individual, group or situation), and to determine the frequency of something that happens. The data used in this research is primary data, which is obtained through surveys, interviews and secondary data, namely those obtained from library materials. From the research results it can be concluded that the sales and transportation agreement between PT. Bumi Laksamana Jaya with CV. Cahaya Silva is carried out to develop existing businesses to be better than before and also to make it easier for the parties to run the business and every time you do a business there must be obstacles that occur, such as time losses due to queuing ferries carrying tank cars only depart once a day with a set time. Sales cannot be done within 24 hours because of the quiet people on the island of Bengkalis, it can only be done from 07.00 to 18.00 WIB in a day. Another obstacle is competition, the large number of small traders selling fuel oil on the side of the road is one of the obstacles because people prefer to refuel on the side of the road
