Abstract

The principle of good faith in general has become a fundamental basis for making and executing contracts, because without being based on good faith the parties involved in the agreement, it is impossible that the agreement will run well as mutually agreed upon. As also in the implementation of the rental agreement, in practice it is known that the first party will provide convenience facilities for the second party, in other words when the second party enters the shop that is to be rented, the condition of the shop is in good condition but there is still a lack of goodwill on the part. shop owner, because when the tenant has agreed to lease the shop he owns, any deficiencies or damage, especially in the floor before being entered by the tenant, will repair the shop, but this is not carried out for various reasons. The main problem of the research is how the principle of good faith is to rent a shophouse between the Pekanbaru Port Loading and Unloading Workforce Cooperative and the Sahabat Motor Store and what are the obstacles to the implementation of the good faith principle to rent a shop between the Pekanbaru Port Loading and Unloading Workforce Cooperative and the Sahabat Motor Shop. The research method is observational research or Empirical Law, by means of a survey. While it is descriptive in nature, which describes the problem clearly and in as much detail as possible about "The Principle of Good Faith Renting a Shophouse Between the Unloading Workers Cooperative of Pekanbaru Port and the Sahabat Motor Shop". The results showed that the principle of good faith rent to rent shophouses between the Pekanbaru Port Loading and Unloading Workforce Cooperative and the Sahabat Motor Shop was carried out properly, namely by submitting the object to be promised, namely the shop building by the Unloading Workers Cooperative to the Sahabat Motor Shop, however after the agreement to lease the shop, a problem arises where any deficiencies or damage, especially in the floor before being entered by the tenant, will repair the shop, but it is not implemented for various reasons. This situation seems incompatible with the conditions to be rented, thus showing, and obstacles in the implementation of the principle of good faith rent to rent shophouses between the Pekanbaru Port Loading and Unloading Workforce Cooperative with the Sahabat Motor Shop is due to financial problems so that rental payments are late or not in accordance with contracted, which results in damage to the shop building such as floors that have been damaged, it is slow for the lessor to repair them. But this is due to the lack of responsibility on the part of the Pekanbaru Port TKMB Cooperative to carry out the agreement to fix it.
