Abstract

Abstract Recently, more and more marriages are held only in Islam, especially when the gifts and ceremonies stipulated by customary law are too burdensome for the people concerned. The terms that are symbols of customary rules have almost faded, and their place has been replaced by Islamic rules. Over time, the prohibition of clan marriages in Batak customs, in some communities there was a conflict between pro and contra groups. The pros are those who stick to customs. Meanwhile, the cons are those who adhere to Islamic teachings and the heterogeneous urban Batak community as is the case in the research that the researcher did. The main problem in this research is how to carry out clan marriages in the Mandailing Batak community in the Overseas land, what are the consequences of clan marriage in the Mandailing Batak community in the Overseas land. However, this type of research is empirical, from its descriptive-analytical nature, while the data collection tool in this research is through interviews, questionnaires and observations relating to the implementation of family marriages in the Mandailing Batak community in Tanah Rantau (Study in the village of Promise Raja Rokan Hulu). The implementation of clan marriages carried out in the promised village of raja rokan upstream is the same as that carried out in the Mandailing community in general, the difference only lies in the customary assembly to determine customary sanctions against the perpetrators of clan marriages carried out at the manulak sere stage (handing over the dowry) to the woman if the community If the customary law violates these provisions, a ceremony and the fulfillment of sanctions will be carried out before marriage and must meet separate procedures due to the marriage, such as those related to the clan of the prospective wife, and deliberation on the fulfillment of customary sanctions. As well as indigenous peoples who transmigrate from their areas of origin, customary law remains attached to their communities to the overseas lands, so that customary provisions must remain a benchmark even though customary institutions are still formed in overseas lands as a legal umbrella for the Mandailing Indigenous people, especially from the aspect of marriage, even to Overseas lands, even for marriages that are contrary to customary law, will still be subject to customary sanctions in the form of disirang mangolu.
