Abstract

The Toba Batak community is one of the ethnic groups originating from North Sumatra. Every Toba Batak must have a surname behind his first name. A clan is a kinship group that includes people who have a common grandfather, or who believe that they are descended from a common grandfather according to the interests of a patrilineal line or take a lineage from the father. Members of the same clan or clan are prohibited from marrying. All people whose surname is related, and with other people whose clans can also be searched for kinship links, and may have kinship relations with aunts, uncles or other relatives, through marital relations. The main problem of the research is how the implementation of clan giving to the Toba Batak people in the marriage process in the Pinggir district, and what are the legal consequences for the continuation of the giving of the clan to the Toba Batak people in the suburb. The research method is a type of legal research, observational research or survey, while its nature is descriptive, that is, where the author describes in a clear and detailed manner the problems to be studied. The result of the research that the implementation of clan giving to Toba Batak people in marriage in Pinggir District is because in Toba Batak custom, mixed marriage is not known. So, every person who is not a Batak Toba, who will marry a Batak Toba, must first be included as a member of the Batak Toba community through the "Mangain" ceremony of giving the clan. Mangain (Pampe Marga) or giving a clan is an affirmation from the pengin (the party to be given the clan) to become the guardian parent of the other party. By carrying out the ratification or inauguration of the clan according to Toba Batak customs, non-Batak women/men become members of the Batak indigenous community and are part of the clan alliance of their choice, and the legal consequences for the continuation of the granting of clans to Toba Batak people in the suburbs are the division of clans has two consequences. by law, namely since the granting of the clan, formally the non-Batak women/men who are appointed have become Toba Batak residents according to the legalized clan and have the same position, rights and obligations as other indigenous people.
