Abstract

ABSTRACT PT. Indah Logistik Internasional as one of the companies engaged in freight forwarding services has an obligation to be responsible if a case occurs that can harm its consumers. there are many factors that cause shipments to experience cases of delay or damage, whether originating from unpredictable natural factors or from the negligence of the courier or carrier themselves, these things can cause losses to consumers. The formulation of the problem in this study is how the process of shipping goods carried out by PT. Indah Logistik Internasional and the forms of responsibility of PT. Indah Logistik Internasional for goods/packages that are delayed and damaged when viewed from a positive legal perspective. This type of research is an empirical research with a descriptive approach because it only sees not analyzes and only finds the problem. Descriptive research aims to solve existing problem solutions based on data. The results of this study indicate that the process of implementing the delivery of goods carried out by PT. Indah Logistik Internasional was carried out not in accordance with the procedures contained in the standard clauses. The form of responsibility given by PT. Indah Logistik Internasional to consumers has not fully complied with UUPK Article 19 paragraphs (1) and (2) as well as Article 1365 of the Civil Code, because PT. Indah Logistik Internasional only provides compensation for a maximum of 10 times the shipping cost, while the losses suffered by consumers are much greater.
